TERMS OF SERVICE 

KTM clearly defines its responsibilities to customers through the key terms outlined in the service cooperation agreement between both parties, as stated in the “Terms of Service” below.

KTM is a company specializing in providing Facebook Marketing & Advertising solutions, supporting businesses in achieving business efficiency by enhancing their competitive advantages and reaching potential customers through various methods.

Customer rights and obligations

1.1. Make full and timely payment of service fees and any additional costs (if applicable) to KTM Ads.

1.2. Approve the strategic implementation plans developed by KTM within a reasonable timeframe to ensure that KTM’s work execution under the contract is not delayed or interrupted.

1.3. Assign an authorized and competent representative to ensure effective coordination and execution of marketing and advertising strategies with KTM.

1.4. If the customer unilaterally cancels or modifies the service or scope of work specified in the contract, negatively impacting the execution of the signed agreement, the customer agrees to take full responsibility for any undesired outcomes in marketing strategy and advertising effectiveness.

1.5. Make full and timely payments to KTM Ads as stipulated in the contract.

1.6. Other rights and obligations as stated in the contract.

Rights and obligations of KTM Ads

2.1. Ensure that the services provided align with the customer’s needs.

2.2. Take responsibility for the effectiveness of the business strategy advised and address any arising issues during service usage (if applicable).

2.3. Support customers in technical and professional activities throughout the contract execution.

2.4. Develop and present advertising strategy execution plans based on customer requirements and make necessary modifications to optimize the campaign.

2.5. Execute work according to the agreed requirements and project timelines as outlined in the contract and its appendices.

2.6. Regularly monitor, supervise interactions, and maintain communication with customers through various channels to provide timely support and resolve inquiries according to the initially agreed-upon advertising strategy.

2.7. Be available to support customers at any time to foster long-term cooperation between customers and KTM.

2.8. Take full responsibility for any errors in executing the advertising strategy and notify the customer proactively to implement necessary adjustments.

Contract termination

3.1. The contract may be terminated before its expiration under the following circumstances:

  • Both parties mutually agree to terminate the contract.
  • A serious breach of any contract term by either party remains unresolved within 14 days from the date of notification by the other party.

3.2. Upon deciding to terminate the contract, both parties shall assume the following responsibilities:

  • The customer must pay KTM for the amount of work completed based on the total agreed-upon service volume. Additionally, the customer must pay an extra 20% service fee based on the total contract value.
  • KTM must hand over any ongoing projects or services to the customer after the customer fully settles all deployment costs and service fees, maintaining the status as of the termination date.

3.3. If the customer unilaterally terminates the contract without mutual agreement, they must compensate KTM for the full contract value.

Payment terms and methods

4.1. Depending on the contract, customers may be required to pay 100% upfront or provide a deposit (split into two payment phases) to KTM.

4.2. In cases where the customer delays the second payment, they must pay an additional late fee calculated based on bank interest rates:

Formula: 150% x monthly loan interest rate x number of delayed months x monthly service fee
